‘Record-Herald Circulation Offi cials File Praecipe in Cir cuit Court. George W. Gardner , formerly agent in this city for the Chicago Record Herald, this morning was made defendant in a $10,00 damage suit brought by that company. The suit is said to grow out of the circulation fight between the var ious Chicago papers, and which ex tended to this city. Formerly Represented Paper. Gardner was representative here for a number of the Chicago dailies including the Record Herald, but when the newspaper war was insti tuted chose to remain with the Tri bune, Inter Ocean and Journal, to the exclusion of the other Chicago papers. According to the reports, Gardner is alleged to have tampered with the Herald’s circulation to the extent of refusing to turn over the list of sub scribers to the company, and is fur ther said to have given the lists to the other Chicago papers for the pur pose of canvassing. Refuse to Discuss Case. Officials of the Record Herald com pany today refused to discuss the matter, further than to acknowledge that the suit had been started, and that it had grown out of the recent controversy. The case is being handled for the Record-Herald by Attorneys Matz, Fisher Boyden of Chicago. Only the praecipe has been filed to date. Outside of the filing of the prae cipe in this suit there were no fea tures of the circulation, fight , de veloped today.verything , is quiet and each of the papers concerned in the trouble is making its regular deliveries.
